2. ACCEPTANCE OF THE GENERAL TERMS OF USE
The purpose of this document is to define the general terms and conditions (hereinafter the
"Terms of Use" or "TOU") under which users (hereinafter the "Users”) have can browse and
use the following website, provided by EASYENCE: https://www.easyence.com/ (hereinafter the “Website").
By using the Website, the User is presumed to have accepted the TOU and to have agreed
to respect them.
3. USE OF THE WEBSITE
Prior to use of the Website, the User must ensure that devices, used to access the website,
are up to date, does not contain any viruses and meet the technical configurations of the
Website.
At any time, EASYENCE may modify, edit, delete, add, change or simply update the
Website or any content (hereinafter the “Content(s)”) in whole or in part, available on it.
4. USER OBLIGATIONS
- to refrain from using the Website illegally, for any illegal purpose or in a manner
that violates the present TOU; - not to use the Website for the publication of abusive, defamatory, harassing,
defamatory, obscene, pornographic or threatening remarks, and/or infringing on

patent, trademark, trade secret, intellectual property right or other proprietary
right belonging to others; - not to post, email or in any other way transmit any unsolicited or unauthorized
advertising or promotional material (including "spam" or any other form of
solicitation) - not to use the Website or abusive purposes by voluntarily introducing viruses or
any other malicious program and not to attempt to gain unauthorized access to
the Website;
not to denigrate the Website and/or EASYENCE and/or other Users on social
networks or any other means of communication.
EASYENCE reserves the right to suspend, modify, restrict or interrupt, either temporarily or
permanently, the access, navigation, use, accommodation and / or downloading of the
content and / or use of the website services, as well as to take any action including legal
action against them, if EASYENCE considers that Users are failed to comply with current
TOS.
5. ACCURACY AND LAWFULNESS OF INFORMATION
The User guarantees that all the information he provides about him is accurate, up-to-date,
sincere and complete.
The User acknowledges that EASYENCE does not have the material means to verify the
veracity of all the information on the Website. EASYENCE cannot therefore be held liable in
the event of identity theft, or because the information mentioned is false or misleading.

6. INTELLECTUAL PROPERTY RIGHTS
By accessing the Website, Users acknowledge that the Website and any Content present on

the French Intellectual Property Code as well as by applicable international treaties and
agreements relating to the protection of intellectual property rights. As such, they may not be

EASYENCE is the sole owner of all rights, including intellectual property rights, title and

EASYENCE grants a non-exclusive license to Users to use the Website and its Contents
strictly in accordance with these TOU.
Any reproduction, representation, adaptation, exploitation, distribution, broadcasting,
commercial use, translation, arrangement, transformation or any creation of derivative or
composite works of all or part of the works and/or any other Content appearing on the
Website on any support whatsoever and by any process whatsoever, current or future, is
expressly prohibited.
These actions are likely to constitute acts of counterfeiting punishable under criminal and
civil law, engaging the responsibility of their author.
The systematic and repeated extraction of information and Contents appearing on the
Website is strictly prohibited and sanctioned under the intellectual property law and the sui
generis right of databases. Any illicit extraction may engage the civil and penal responsibility
of its author.

EASYENCE shall not be held liable for any damage, direct or indirect, resulting from
fraudulent actions by a third party, beyond the control of EASYENCE, leading to a

and/or software of Users.

acknowledges that the Company cannot be held liable for the availability of these External

9. TRADEMARK INFORMATION
« EASYENCE », and all other trademarks and logos of the EASYENCE are trademarks
protected by European and international laws on intellectual property (hereinafter collectively
referred to as "Trademarks").
Unless expressly authorized in writing by the Company, the User is prohibited from using,
registering or disseminating the Trademarks in any manner and for any reason whatsoever.
This prohibition extends to all signs reproducing the EASYENCE Trademarks, such as, but
not limited to: corporate names, trade names, signs, domain names, designs, etc.
10. PERSONAL DATA PROTECTION
The provisions relating to the protection of personal data are contained in the Privacy Policy
available on the Website.
11. APPLICABLE LAW AND JURISDICTION
These TOU are governed by and interpreted in accordance with French law, without
considering the regulations applicable in the event of conflicts of laws.
In the event of a dispute that may arise during the interpretation and/or execution of these
TOU or in connection with them, the competent courts will be those determined by the Code
of Civil Procedure.
